akb Mr. Sk Nezamuddin Mr. Debasish Kundu ...For the Petitioner Mr. Pantu Deb Roy Ms. Anand Farmania ...For the State Respondents This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by non-consideration of her representation dated September 10, 2021, annexed as annexure 'P-3' at page 19 to this writ petition with regard to relaxation of tax and fine regarding vehicle Registration No. WB 29A 6109 by the respondent authorities.

I have heard learned counsel appearing on behalf of the parties and perused the materials placed on record. The Secretary, Regional Transport Authority, Purba Medinipur, being the respondent No. 4 is directed to consider the representation September 10, 2021 made by the petitioner upon giving an opportunity of hearing to the petitioner and pass a reasoned order within a period of six weeks from date. The reasoned order should be communicated to the petitioner within a period of two weeks from the date of passing of the same.

Needless to mention if the reasoned order is in favour of the petitioner, the authorities are directed to act in accordance with law.

With the aforesaid direction, the writ petition is disposed of.

Since, no affidavit-in-opposition has been called for, the allegations made in the writ petition are deemed to have not been admitted by the respondents.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
