This is an application for direction of expeditious disposal of a case under the Narcotic Drugs and Psychotropic Substances Act which is registered as case No.N-185 of 2020 before the learned Judge, Special Court (NDPS) and the Additional Sessions Judge, 6th Court at Barasat.

It is submitted on behalf of the petitioner that the petitioner was arrested in connection with Gobardanga Police Station Case No.228 of 2020 on 12th September, 2020. Since then he is in custody. Charge-sheet has been submitted against the petitioner under Section 21 (C) of the Narcotic Drugs and Psychotropic

Substances Act on 9th February, 2022. When the accused pleaded not guilty, date was initially fixed on 12th May, 2022 for examination of the witnesses on behalf of the prosecution.

It is also submitted on behalf of the petitioner that there are 10 charge-sheeted witnesses. Till date none of the witnesses has been examined. The Trial Court fixed 1st and 2nd September, 2022 for recording evidence of the witnesses. The learned Advocate for the petitioner has also drawn my attention to the order dated 12th May, 2022 where the learned Trial Judge specifically observed that the learned Special Public Prosecutor did not take any step for production of witnesses.

Under such circumstances, the instant criminal revision is disposed of directing the Trial Judge to instruct the Special Public Prosecutor to produce at least 6 witnesses on the next schedule for examination.

He is further directed to dispose of the case within next six months from the date of communication of the order passed by this Court.

The instant criminal revision is, thus, disposed of. (Bibek Chaudhuri, J.) Mithun De/ A.R. (Ct).
