The petitioner says that he has been falsely implicated. This is a matter of case and counter-case. He himself was also injured and was in hospital for 25 days. He is in custody for 172 days. Charge is yet to be framed. The State opposes the prayer for bail.

We have seen the material in the Case Diary. There are at least three eye-witnesses who recorded statements under Section 164 of the Code of Criminal Procedure. They directly implicate this petitioner who attacked the lady victim with a sword injuring her fatally.

In view of such prima facie incriminating material against the petitioner, we are not inclined to entertain the prayer of the petitioner for bail, at this stage. Signed By :
