The petitioners allege violation of the direction passed by the Court on December 5, 2023.

Learned counsel for the alleged contemnor/Pradhan, 1 no. Sultanpur Gram Panchayat submits, upon instructions, that the order of the Gram Panchayat has been forwarded to the Sub-Divisional Officer, Ghatal with a request to remove all illegal encroachment vide communicating letter dated October 23, 2024.

Submission is that no action has been taken from the end of the Sub-Divisional Officer.

It appears from the submissions made on behalf of the parties that the concerned Gram Panchayat took steps to comply with the order passed by the Court and upon arriving at a finding that there has been unauthorized construction, has forwarded all documents to the concerned Sub-Divisional Officer for taking further steps in the matter.

In view thereof, the Court is not inclined to proceed with the contempt application any further. The contempt application stands disposed of.

It will be open for the petitioners to challenge the inaction on the part of the Sub-Divisional Officer in taking steps in furtherance of the order passed by the Gram Panchayat before the appropriate forum in accordance with law, if so advised.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

Certified copy of this order, if applied for, shall be made available to the parties.
