(Via Video Conference) Mr. Shamim Halder ... for the petitioner Mr. Supriyo Chattopadhyay, Mr. Sabyasachi Mondal ... for the State The petitioner is a primary school teacher. His grievance is that his date of birth has been wrongly entered in his service book.

The petitioner relies upon the birth certificate issued by the Gram Panchayet, Durgapur - II sometime in the year 2021 and submits that the date of birth recorded in the said birth certificate i.e. 13th December, 1985 be recorded in his service book. The petitioner appeared in the Madhyamik Pariksha (Secondary Examination) in the year 2001. The date of birth recorded in his admit card is 10th April, 1983.

The petitioner claims to have approached the Secretary of the West Bengal Board of Secondary Education praying for correction of his date of birth by a representation dated 11th August, 2021.

It appears that the petitioner from 2001 till 2021 did not take any steps for correction of his date of birth in the admit card issued in his favour by the West Bengal Board of Secondary Education.

The petitioner after being appointed in the school in April, 2017 suddenly woke up his slumber and sought to rectify the date of birth in his service book.

The prayer of the petitioner cannot be accepted. The petitioner did not take any steps to rectify the date of birth when it was initially mentioned in the admit card of Madhyamik Pariksha (Secondary Examination) in the year 2001. Late in the year 2021 the prayer for correction of his date of birth relying upon subsequent documents cannot be entertained. The writ petition fails and is hereby dismissed. Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
