Mr. N. Ahmed Ms. Trina Mitra .... For the State. This matter also relates to the ponzi scam in which the organization SBF Network Marketing was involved. Co-accused have been released on bail on the ground that they were employees and did not have a direct role in the alleged offence. Mr. N. Ahmed learned advocate for the respondent submits that the petitioner accused in this case had been actively acting as the agent of the organization and collecting money. The accused is in custody for 122 days and investigation is complete. According to Mr. Ahmed further custody of the petitioner is required to enable the respondent to trace the fund and find the misappropriative fund has been applied by the petitioner. The petitioner is in custody for 122 days. Investigation has been completed. Other accused are enlarged on bail. The chargesheet has been filed.

We can only permit the respondent to detain the petitioner for a limited period to proceed with further investigation and file a supplementary chargesheet, if any.

We think that one month's time is sufficient. In that view of the matter on and from 19th September, 2022, the petitioner shall be released on bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each, one of

whom must be local, to the satisfaction of the learned Additional District Judge, 3rd Court Alipur, subject to the following conditions:-

1. The petitioner is to deposit her passport, if she has one, with the investigating agency within three days from date;

2. She will meet the investigating officer as and when summoned

3. She shall not leave the municipal limits of the Kolkata without informing the investigating officer.

4. She shall not tamper with evidence or interfere with the witnesses in any manner.

5. The petitioner shall attend the court on each and every day of trial, in default, the court shall be at liberty to cancel the bail bond without any reference to this bench. (Subhendu Samanta, J.) (I.P. Mukerji, J.)
