Mr. Tarun Kumar Jana ...for the petitioner Having considered the submission of learned advocate for the petitioner seeking expeditious disposal of an Execution Case, being Money Execution Case No.04 of 2021, now pending before the Learned Judge, 7th Bench, City Civil Court, Calcutta, alleging the petitioner/decreeholder to be a senior citizen, the Court is of the view that no prior notice is necessary, in view of the nature of the order sought to be obtained. Accordingly, service of notice upon the opposite parties/judgement debtors stands dispensed with.

Learned executing court below is directed to ensure expeditious disposal of the pending execution case providing sufficient opportunities of hearing to either of the parties to this case, but without granting unnecessary adjournment, unless the same is extremely unavoidable, so that logical conclusion of the case maybe reached at an early date.

With the above observations/directions, the instant revisional application stands disposed of.

Petitioner is directed to make communication of this order to the opposite parties/judgement debtors and their learned advocate appearing in the court below, Urgent certified photostat copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of all necessary formalities.
