The petitioner prays for appointment as Dealer for Supply of Foodgrain, Kerosene etc. He made an application before the Sub-Divisional Controller, Food & Supplies, Barasat on 29th September, 2020 along with requisite fees.
The grievance of the petitioner is that the said application is yet to be disposed of by the respondents.
The petitioner relies upon a communication dated 22nd September, 2021 made by the SubDivisional Controller, Food & Supplies, Barasat wherein it has been mentioned that the entire case file has been forwarded to the District Controller, Food & Supplies, North 24 Parganas vide memo No.
1075/SCF&S/BST/MR/2021 dated 18th August, 2021.
However, it appears from the submission made on behalf of both the parties that the application is yet to be finally disposed of by the respondents.
In view of the above, the instant writ petition is disposed of by directing the concerned authorities of the respondents to take a decision with regard to the application filed by the petitioner for dealership in accordance with the West Bengal Public Distribution System (Maintenance and Control) Order, 2013 at the earliest, but positively within a period of six weeks from the date of communication of a copy of this order. The respondent authority will intimate the fate of the application to the petitioner immediately thereafter.
The learned advocate representing the Bidhannagar Municipal Corporation submits that the Corporation does not have any role to play in this matter.
Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
