From the report forwarded by the Inspector-inCharge, Panskura Police Station, Purba Medinipur, dated 4th July, 2024, it appears that on 29th June, 2024 the minor victim girl was recovered from the Panskura bus stand area. Her statement under Sections 161 and 164 Cr.P.C. have been recorded. The victim girl is right now in the Sister Nivedita Children Home, Purba Medinipur.

It has been submitted by the learned advocate representing the petitioner that the appropriate Sections have not been incorporated in the FIR.

The child being a minor, the proper sections of the POCSO Act and the appropriate sections of the IPC ought to have been added.

The police is directed to add the necessary sections.

The investigation ought to be conducted strictly in accordance with law and concluded at the earliest. It will be open for the petitioner to approach the learned Court in seisin of the matter for further relief. The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
