As the same questions are involved in both the revisional applications, the revisional applications being CRR 2385 of 2023 and CRR 2427 of 2023 are disposed of by a single order. Both the revisional applications arise out of and relate to NDPS Case No.44 of 2021 which is pending before the learned Judge, Special ADJ, 4th Court, Alipore.

The genesis of the case relates to NCB Crime No.17/NCB/KOL/2021 datd 23.05.2021.

Attention of this Court has been drawn to an order dated

29th February, 2024 passed in CRM (NDPS) No.1974 of 2023. Mr. Sandip Chakraborty, learned advocate appearing for the petitioners in both the revisional applications submits that in view of the Hon'ble Division Bench of this Court passing an order, at this stage if any application is filed praying for discharge, the same may be considered by the learned special court. I find from the directions so passed by the Hon'ble Division Bench that it has directed the trial court to consider the charge on the adjourned date, i.e. on 7th March, 2024. Since the petitioners were not parties before the Hon'ble Division Bench, I direct that in case a discharge application is filed before the learned special court at the stage of consideration of charges, the learned special court will consider their contentions and dispose of the same in accordance with law. With the aforesaid observations, the revisional applications being CRR 2385 of 2023 and CRR 2427 of 2023 are disposed of.

Pending connected applications in connection with the said revisional applications, are consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
