In the matter of:- Saddam Ali Mondal Mr. Nimai Ray .....for the petitioner Mr. Tapandeb Nandy Mrs. Debjani Sahu Mr. Antarikhya Basu .....for the State This is an application seeking an expeditious disposal of a proceeding in which a charge-sheet was submitted under Sections 21(c) and 29 of the NDPS Act. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is an accused in this case. He is in custody since 07.12.2019, the date on which an FIR was reregistered. On 10.02.2020, a charge sheet was submitted citing six witnesses. However, a prayer was made for filing a supplementary charge sheet along with the chemical report. But, till date the same has not been filed. The proceeding is pending for no fault of the present petitioner.

Learned counsel appearing on behalf of the State relies on the case diary and submits as follows. A chemical report has already been obtained by the investigating agency and it has come positive for the narcotic substance. Accordingly, a supplementary

charge sheet dated 22.09.2021 has already been submitted. However, since the petitioner is in custody, the State would not come in the way if a direction is passed to expedite the trial.

I have heard submissions of the learned counsels appearing on behalf of the petitioner and the State and have perused the revision petition.

It appears that there is an inordinate delay in concluding the proceeding, especially considering the fact that the petitioner is in custody since 07.12.2019. In view of the above and in the interest of justice, I request the learned trial court to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties, preferably within a period of one year from the next date of hearing.

With these observations, the revisional application is disposed of.
