Md. Mansur Rahaman v. State Of West Bengal And ORS.
06.07.2023 d.p.
In The High Court At Calcutta Constitutional Writ Jurisdiction Appellate Side W.P.A 15608 of 2023 Md. Mansur Rahaman -versus The State of West Bengal Ors.
Mr. Shayak Chakraborty, Mr. Soham De Dhara.
...For the Petitioner.
Mr. Lalit Mohan Mahata, Mr. Rudranil De.
...For the State.
Ms. Sonal Sinha, Mr. Sujit Gupta, Mr. Sayan Datta, Mr. Soumen Chatterjee ...For the State Election Commission.
The petitioner claims to be a self-employed person. He was deployed for election duty. Challenging the same the present writ petition has been filed. Learned advocate appearing for the Commission submits, upon instructions, that there is no provision for appointment of non-government employees for engaging as polling officer in connection with the Panchayat General Elections, 2023.
As the petitioner is neither a government employee nor has been classified as contractual employee or a Civil Defense Volunteer or a Cadet under NCC, accordingly, the petitioner has been relieved from the duty of the fourth Polling Officer.
In view of the above instruction forwarded by the Commission, the relief sought for by the petitioner stands allowed.
The writ petition stands disposed of.
