The petitioner has drawn the attention of this Court to an order dated February 26, 2020, passed by the Deputy Secretary, State Transport Authority, West Bengal, who, after considering the petitioner's grievance, passed the following order:
"After going through the documents, it is revealed that PStP No.10/2010(I/S) was issued for the Inter-State route Midnapur to Tata via Kharagpur which covers the distance of 150 km but the vehicle is plying through Keshiary, Kharika, Gopiballavpur, Bhasraghat, Baharagora, the distance of which is 218 km.
After careful consideration of the facts, the permit holder of PStP No.10/2010(I/S) is directed to ply the vehicle as per approved route in terms of Reciprocal Transport Agreement and also directed to submit a fresh clashfree time table in accordance with the approved
route i.e. as per Reciprocal Transport Agreement, 2004 immediately."
Mr.
Amal Kumar Sen, learned advocate appearing for the State, submits that a communication was made on August 7, 2025, by the Regional Transport Officer (RTO) and ex-officio Assistant Director, State Transport Authority, West Bengal, to the concerned authorities for conducting an enquiry against respondent no. 7 for the alleged violation of the permit conditions.
It is unclear why a further enquiry is required when the relevant authority has already found that respondent no. 7 is not operating his vehicle in accordance with the route specified in his permit. In view of the above, I direct the State Transport Authority, West Bengal, to take necessary action against respondent no. 7 in accordance with law for violation of the permit conditions issued in his favour. Such action shall be completed within one month from the date of communication of this order. It is further noted that a similar order has been passed against the petitioner by the Secretary, State Transport Authority, West Bengal, dated May 23, 2025, for violation of the permit conditions issued in his favour.
Needless to mention, respondent no. 7 shall be at liberty to take appropriate steps in accordance with law for the implementation of the said order dated May 23, 2025.
Accordingly, WPA 15619 of 2025 is disposed of.
