1. Parties are represented through their respective counsels.

The State Transport Authority, Jharkhand files a report as directed vide order dated 07.01.2026 with regard to the countersigning of the permit issued by the STA, West Bengal. The report filed be kept with the record.

2. From the report it transpires that the STA, Jharkhand has no objection to counter-sign the permit provided the time table issued by the STA, West Bengal, is revised as per the proposed variation agreed upon by and between the petitioner and the objector operating from Jharkhand.

3. It is apparent from Clause (d) of Paragraph V of the report at page 4 that a written consent letter dated 20.01.2026 has been submitted before the

authority concerned with regard to the departure of vehicle of the petitioner and the objector operating from Jharkhand.

The learned counsel appearing for the STA Jharkhand relies upon paragraph 6 of the report which is reproduced below:- " Therefore, in the light of the above facts, an order was passed that, the applicant Shri Swapan Kumar will ensure that the STA, West Bengal Authority allot a non-conflict revised time table where, in place of departure time of the Vehicle of the applicant Shri Swapan Kumar Dey for Dumka be 01:35 Hrs. instead of 01:45 Hrs. to Dumka, to the STA, Jharkhand Authority, so that the process of countersignature renewal with non-conflict time-table can be done at the level of STA, Jharkhand Authority as per rules."

After careful consideration of the case based on the report filed by the STA, Jharkhand, I am of the considered view that since both operators have mutually consented to ply their vehicle at a schedule time table as mentioned in the consent letter dated 20.01.2026 annexed to the report, STA Jharkhand shall forthwith counter-sign the permit within a period of two weeks from the date of communication of the said order since the same is pending for a considerable period of time.

6. It is made clear that counter signature shall not be kept pending till the date of the allotment of the revised time table. The time table shall be revised accordingly as per the timings mutually agreed upon by the petitioner and objector.

7. The STA, West Bengal is directed to forward the revised time table to the STA, Jharkhand after receiving the same from the petitioner.

8. After obtaining the counter-signature from STA Jharkhand the petitioner is at liberty to ply the vehicle as per the timings mentioned in the written consent letter dated 20.01.2026.

9. The writ petition being WPA 15467 of 2025 is disposed of without taking an exception to the merits of the case.
