The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite party, as such, service of notice of the present application upon the said opposite party is dispensed with. The opposite party being the named executor of the alleged last Will and testament of his mother, namely, Jyotsna Sur applied for grant of probate of it.

The petitioners, being the daughters of testatrix, have objected to the said grant, as a result the proceeding has become contentious and is pending before the 1st Court of learned Additional District Judge at Barasat being O.S. No. 42 of 2010.

The petitioners are alleging delay in disposal of the said suit and are praying expeditious disposal of it.

It appears from the record that the said proceeding is pending since 2010, as such the learned Trial Judge is requested to dispose of it as expeditiously as possible in accordance with law and in doing so shall not grant any unnecessary adjournments to either of the parties. C.O. 2275 of 2024 is disposed of with the above terms without any order as to costs.
