The petitioner's father died-in-harness on September 12, 2020. The petitioner applied for appointment on compassionate ground. The Block Development Officer, Khargram Development Block, by an order dated February 16, 2022, constituted a three men committee as per government policy to assess the eligibility criteria and financial conditions of the petitioner. The constitution of the three men committee was also intimated to the District Panchayat & Rural Development Officer, Murshidabad. The report was forwarded to the said authority and the committee recommended that the petitioner may be considered for service on compassionate ground. A copy of the same was also submitted before the Executive Officer, Khargram Panchayat Samiti.

No further steps have yet been taken by the District Panchayat & Rural Development Officer, Murshidabad, although the report of three men committee was forwarded on March 22, 2022.

This writ petition is disposed of with a direction upon the District Panchayat & Rural Development Officer, Murshidabad to act in terms of the government policy and notifications and to take further steps on the basis of the report of the Block Development Office and the three men committee, strictly as per law. Such action shall be taken within a period of six weeks from the date of communication of this order. The petitioner will be communicated the subsequent steps that shall be taken by the authorities in this regard. This order shall not be construed as an observation of the court on the merits.

Accordingly, the writ petition is disposed of. There will be however no order as to costs.

All parties are directed to act on the basis of server copy of this order.
