AND In the matter of:- Tamal Kanti Das ... petitioner Mr. P. K. Pakrashi, Ms. N. Islam ...for the petitioner The petitioner is aggrieved by the nature of evidence which has been presented before the learned trial court and prays for quashing of the proceedings.

From the orders which have been enclosed along with the revisional application, it reflects that evidence has already commenced and date has been fixed for cross-examination. Having regard to the stage of the case, I am of the view that no interference is necessary at this stage when the trial of the case is under progress.

Petitioner is granted liberty to agitate the point canvassed in the revisional application at the stage of final argument of the case before learned trial court.

In view of the fact that the petitioner complained of the present case pending for last seven years, learned Magistrate will take all efforts to conclude the same within a reasonable period of time.

With the aforesaid observation, the revisional application being C.R.R.2095 of 2021 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act in terms of copy of this order downloaded from the official website of this Court.
