Mondal Ms. Riya Das ... for the Petitioner(s) Mr. Dipanjan Dutta Ms. Rinku Sen ... for the State-respondent(s) The petitioner is aggrieved by the fact that inspite of Chanditala PS Case No. 485 of 2025 dated 25.06.2025 was registered for investigation and there have been offences committed under Sections 118(2)/109/76 of the BNS, 2023, the police authorities are not putting any efforts for tracing out the accused persons who are adamant by staying out of the purview of the investigation and are threatening the petitioner and his family members.

State has submitted a report

which reflects that one of the accused person was arrested and was produced before the learned ACJM, Serampore, Hooghly and steps are being taken for tracing out the other accused persons.

In case, the police authorities are of the view that tracing out of the accused persons may be affected by certain impediments, they would advance appropriate prayer before the learned ACJM, Serampore, Hooghly for issuance of harsher process of law.

The police report also reflects that there is a long standing dispute pending between the petitioner and the accused persons.

Be that as it may, since the investigation commenced, the police authorities would put in best of their efforts to take the investigation of the case to its logical conclusion within a reasonable period of time.

Since the case was registered on 25th June, 2025, the defacto-complaint must be informed by 30th September, 2025 regarding the progress of the investigation.

However, if the petitioner is faced with inconveniences and threats at the behest of the accused persons, he would take out an appropriate application before the learned ACJM, Serampore, Hooghly, and the learned Magistrate would call for a threat perception report, thereafter, pass necessary directions under the Witness Protection Scheme, 2018.

With the aforesaid observations, WPA 15410 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. Copy of the report be handed over to the petitioner.
