1. Mr. Nayak, learned Advocate representing the Cooperative Election Commission, West Bengal, would by placing before this Court an internal communication dated 6th August 2025 issued by the Assistant Returning Officer, Birpur SKUS Limited

and the Assistant Registrar of Co-operative Societies, Nadia Range, submit that the final list of the Members eligible to vote have been rectified by publishing a supplementary list of dead voters wherein the name of the voters, who have since died, have been identified.

Let the aforesaid communication dated 6th August 2025 be taken on record.

Shah, learned Advocate representing the petitioners in WPA 18003 of 2025, would submit that her clients' representation have been considered and on the basis thereof, revised voter list has been published. She, however, claims that names of 160 voters has been deleted.

Although the aforesaid submission does not tally with the disclosure made by Mr. Nayak, however, since, steps have been taken by the Cooperative Election Commission, West Bengal, to redress the grievance of the complainants, I am of the view that nothing survives in the writ petition being WPA 18003 of 2025. In so far as writ petition being WPA 15520 of 2025 is concerned, I find that steps have already been taken to complete the election process in terms of the Election Schedule published on 30th July 2025. As such no fruitful result will be achieved by keeping the writ petition pending.

4. Accordingly, both the writ petitions stand disposed of with a direction upon the Cooperative Election Commission to conclude the election process in accordance with law. The local administration and the Superintendent of Police, Nadia, are directed to provide adequate assistance to the Assistant Returning Officer for conducting the polls in free and fair manner.
