08.08.2025 Court No.28 Item No.40 tbsr CRM (A) 2524 of 2025 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Bongaon P.S. Case No.1011 of 2024 dated 05.11.2024 under Sections 85/103(1)/3(5) of the Bharatiya Nyaya Sanhita, 2023. And In the matter of: Chandan Mukherjee & Anr.
....Petitioners.
Mr. N. C. Dey Mr. A. N. Roy ....for the petitioners.
Mr. Rana Mukherjee Mr. Sobhan Gani .....for the State.
Learned counsel appearing on behalf of the petitioners submits that this is a second application for anticipatory bail. The change of circumstance is that two other co-accuseds have been discharged in this case.
Learned counsel appearing on behalf of the State submits that the said co-accused had been discharged prior to the last rejection on 07.02.2025 in CRM (A) 375 of 2025. He submits that charge sheet was submitted on 28.01.2025 whereby two other co-accuseds were not charge-sheeted.
It is evident from the above facts that, there is no change in circumstance so as to maintain the second application for anticipatory bail.
In view of the above, the application for anticipatory bail is dismissed as not being maintainable.
Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
