1. Learned counsel for the petitioner submits that the petitioner was enlarged on bail in 2013 and had been attending the trial regularly except on 18th March, 2024. On account of the said non-appearance, warrant of arrest was issued. Learned counsel submits that pursuant to the warrant of arrest the petitioner was arrested. Learned counsel further submits that the Trial Court rejected the bail application of the petitioner without assigning any reason.

2. Learned counsel for the State has opposed the bail application on the ground that the petitioner remained absconding for around one year.

3. The petitioner remained on bail for around 11 years and no record has been brought that during this period petitioner misused the liberty.

4. Taking into the facts and circumstances, let the petitioner be admitted to bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand Only), with two surety of like amount of each, one of whom must be local, to the satisfaction of the Learned ACJM, Kalna, subject to the conditions that the petitioner shall appear before the learned Trial Court on every date of hearing and shall not leave the jurisdiction of Kalna P.S. until further orders and shall not intimidate witnesses and/or tamper with evidence in any manner whatsoever.

5. Thus, the prayer for bail is allowed.

6. CRM (M) 1052 of 2025 is disposed of.

7. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all necessary formalities.
