It is submitted on behalf of the petitioner that the petitioner was served a notice on 9th June, 2011 by the District Magistrate and Collector, Purba Medinipur under Section 3 C (2) of the National Highways Act, 1956 asking the petitioner to appear before the said Authority on 27th May, 2011 in response to the objection filed by the petitioner against the acquisition of his land and the public notice for the same being issued. The petitioner complains that though the land has been acquired and utilised by the Authority, no compensation has been paid to him till date. The petitioner submitted a representation before the concerned Authority on 4th May, 2018 in this regard for release of the amount of compensation in his
favour. The Special Land Acquisition Officer, Tamluk, Purba Medinipur by a letter dated 12th June, 2018 requested the petitioner to mention L.A. case number to enable him to take further action. In response to the said letter the petitioner, by a letter dated 18th June, 2018 informed the Authority that the L.A case number was not stated in the notice served upon him. The petitioner further requested the Authority to do the needful. The said representations have not yet been disposed of. The petitioner prays for a direction upon the Authority to consider his representations at the earliest. Having considered the submissions made on behalf the parties and material on record, the writ petition is disposed of directing the 2nd respondent to consider and dispose of the representations filed by the petitioner dated 4th May, 2018 as also the subsequent letter dated 18th June, 2018 within a period of two months from the date of communication of this order after giving reasonable opportunity of hearing to the interested parties including the petitioner, in accordance with law.
W.P.A. 14941 of 2018 is thus disposed of.
There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
