It now transpires that the petitioner approached this Hon'ble Court under Section 438 of the Criminal Procedure Code seeking anticipatory bail in respect of Dhantala Police Station case No. 384 of 2019 dated December 13, 2019 which was rejected on February 12, 2020.
The petitioner, thereafter, filed the present petition knowing fully well about the earlier order of rejection. In the present petition, in the first paragraph of the petition, the petitioner claims that he did not file any application for anticipatory bail before this Hon'ble Court at any prior
point in time and that this is the first application in connection with the police case.
Such statement being false and false to the knowledge of the petitioner, he should be put on terms. The Court is informed that police requires custody of the petitioner.
The police will take appropriate steps as against the petitioner who is present in Court.
The petitioner will pay a cost assessed at Rs.10,000/- to be paid to the West Bengal Stage Legal Services Authority, Kolkata.
In the event the petitioner applying for bail by the petitioner, it should accompany documentary evidence of payment of such costs.
In such circumstances, prayer for anticipatory bail of the petitioner is rejected.
CRM (A) 3477 of 2022 is dismissed.
