The father of the petitioner was an Assistant Teacher of a Higher Secondary School who died-in-harness on February 03, 2016.

The District Inspector of Schools (S.E.), Malda, the respondent no.3 herein, by the impugned Memo bearing no. 1489/SD dated June 19, 2019 has dismissed the prayer of the petitioner for compassionate appointment on the ground that the family income of the petitioner is more than the gross salary of a Group-D employee of the State Government. It appears from the impugned memo that at the relevant point of time, the widow of the deceased teacher was receiving family pension @ Rs.29,840/- (Rupees twenty none thousand eight hundred forty) which is more than the gross salary of a Group-D employee of the State, as such there is no illegality and/or infirmity in the impugned memo refusing the prayer of the petitioner.

W.P.A. 16041 of 2022 is accordingly dismissed without any order as to costs.
