The order passed by the Maheshtala Municipality on 23rd June, 2023 directing the petitioner to demolish the unauthorized two storied construction is impugned in the instant writ petition. It appears that the order was passed after giving opportunity of hearing to the petitioner.

The order of demolition being an appealable one, the writ Court is not inclined to exercise jurisdiction in the instant writ petition.

The writ petition fails and is hereby dismissed. Dismissal of the writ petition will however, not stand in the way of the petitioner to approach the competent forum in accordance with law, if permissible. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
