Rakib (Allowed) CRM (NDPS) 897 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with NDPS Case no. 32/2024 arising out of NCB Crime No. 03NCB/Kol/2024 dated 06.03.2024 under Sections 8(C)/20(b)(ii)(c) of the Narcotics Drugs And Psychotropic Substances Act.

Learned advocate appearing for the petitioner submits that the subject matter of the case involves 21 kgs of ganja/contraband which were recovered. Petitioner is in custody for one year eight months and there is no possibility of the trial being concluded in close proximity of time. Learned advocate appearing for the NCB on the other hand opposes the prayer for bail and submits that the petitioner is a history-sheeter with other cases of similar nature. Learned advocate further submits that because of absconding of other accused persons the whole process of the present case is being delayed.

Be that as it may, the subject matter of the case relate to 21 kgs. of ganja. Having considered the detention of the petitioner for one year eight months, I am inclined to release

the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed.

As such the petitioner namely, Bhim Biswas shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Special Judge under NDPS Act, Krishnagar, Nadia. If on bail, the petitioner shall be physically present on each and every date before the learned trial Court in seisin of the case. The petitioner shall not leave the jurisdiction of district of Nadia without the prior permission of the learned trial Court.

Accordingly, CRM (NDPS) No. 897 of 2025 is allowed. Report submitted by the NCB be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
