The grievance of the petitioner relates to the delay on the part of the concerned respondents to permit him to make registration of his motor cycle purchased on 20th March, 2020.

Learned counsel appearing for the petitioner submits that although the motor cycle was purchased in March, 2020, the dealer of the motor cycle took considerable period of time to upload the documents on the portal by reason of pandemic. The same was done only in August, 2021. A representation made by the petitioner to the Secretary, Ministry of Road Transport and Highways, Government of India and to the Principal Secretary, Transport Department, Government of West Bengal, for doing the needful is dated 21st August, 2021.

The respondent no. 2 is represented.

No one appears for the State.

Upon hearing learned counsel for the parties, this Court is of the view that WPA 16814

of 2021 can be disposed of with a direction on the respondent no.2, being the Principal Secretary, Transport Department, Government of West Bengal, to consider the representation dated 21st August, 2021 and dispose of the same by way of a reasoned order upon hearing all concerned parties within a period of four weeks from the date of communication of this order. A copy of such reasoned order shall be made available to the petitioner within a week from the date on which such reasoned order is passed.

It is made clear that if the petitioner is found to be eligible to make registration of his motor cycle under the relevant Act and Rules, the concerned authorities shall take immediate steps thereafter.

WPA 16814 of 2021 is disposed of accordingly.
