In the matter of : Shivaji Barma @ Pradyut Kumar Burman. ... petitioner.

The present revisional application has been preferred against an order dated May 23, 2012 passed by the learned Additional Chief Judicial Magistrate, Kurseong, Darjeeling. Order reflects that the learned Magistrate was pleased to direct the husband/petitioner herein to pay maintenance of Rs.1,000/- per month to the wife/opposite party and Rs.1,000/- each to three minor children aggregating of Rs.4,000/- per month. Having regard to the quantum of maintenance so awarded by the learned Magistrate, I am of the view that the same is not excessive and in consonance with the cost of living required for an individual.

As such, the impugned order requires no interference. Accordingly, CRR 2239 of 2012 is dismissed.

Pending applications, if any, are hereby disposed of. Interim order, if any, is hereby vacated.

The opposite party/wife will be entitled to recover such arrears by taking out appropriate application before the learned Additional Chief Magistrate, Kurseong, Darjeeling.
