akb Mr. Debabrata Saha Roy Ms. Gitashree Mistry ...For the Petitioner Mr. Pantu Deb Roy Mr. Anand Farmania ...For the State Respondents Mr. Debabrata Saha Roy, learned Counsel appearing on behalf of the petitioner submits that the petitioner's vehicles has been seized for the reasons that the vehicle having travelled without valid registration certificate, permit and without driving licence of the driver. He submits that till date no penalty amount has been assessed and/or issued to the petitioner and accordingly the petitioner is unable to make payment of the penalty amount in accordance with law.

I have heard learned counsel appearing on behalf of the parties and perused the materials placed on record. The Secretary, Regional Transport Authority, Purba Medinipur, being the respondent No. 3 is directed to immediately issue the amount of penalty payable by the petitioner in accordance with law within a period of 10 (ten) days from the date of communication of this order. In the event, the petitioner makes payment of penalty amount, the respondents are directed to release the vehicle of the petitioner as expeditiously as possible preferably within 48 (forty-eight) hours from the date of payment made by the petitioner.

With the aforesaid direction, the writ petition is disposed of.

Since, no affidavit-in-opposition has been called for, the allegations made in the writ petition are deemed to have not been admitted by the respondents.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
