Petitioner has approached this Court for collection 01.07.2025 Court No. 35 Item No.36 Rakib of the CCTV footage and video footage of the incident dated 07.08.2023 wherein investigation in respect of the Balurghat Police Station Case no.

696/23 dated 31.08.2023 was in progress. Petitioner also complained regarding the genuineness of the injuries complained of in respect of Balurghat Police Station case no. 629/23 dated 07.08.2023.

State has submitted a report. The said report is dated 07.07.2024. Report reflects that there was another FIR being Balurghat Women Police Station case no. 93/22. CCTVs were also considered by the Inspector-inCharge of Balurghat Police Station. The report also reflects that in connection with Balurghat P.S. case no. 696/23 dated 31.08.2023 charge-sheet has been submitted before the Jurisdictional Court. So far as the other case is concerned being Balurghat P.S. case no. 629/23 prayer was advanced for addition of provisions in respect of The Scheduled Castes and the Scheduled Tribes (Prevention of atrocities) Act, 1989, the

investigation of the case at the relevant point of time was continuing.

Having considered the genesis of the case and the police authorities having exercised their rights in consonance with the provisions of law at the relevant point of time, I do not find any scope for interference in respect of the accusations made in the writ petition. As time period has lapsed presumably, the police authorities in respect of each of the cases are bound to have submitted the charge-sheet and/or final report. In case, the petitioner is aggrieved by any act and action of the police authorities he would submit an application for ventilating his grievance before the Jurisdictional Court who are in seisin of the issues.

With the aforesaid observations WPA 16604 of 2024 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
