Report submitted by the State be kept with the record. The report is enclosed with statement and a communication of Ambika Arora which has been recorded virtually and received by way of email respectively.

The subject matter of challenge relates to Kalighat Police Station case no. 87 of 2018, dated 31.05.2018 under Sections 341/504/506/509 of the Indian Penal Code. The Opposite Party No.2 being the de facto complainant has expressed her intention to withdraw the aforesaid case and do not intend to pursue the same. Having regard to the nature of offence complained of and the initiation of case having its origin in a matrimonial dispute or

discord, I am of the view that further continuance of proceeding is unwarranted.

Accordingly, all further proceedings of Kalighat Police Station case No. 87 of 2018 including the charge-sheet filed therein which is pending before the learned Judicial Magistrate, 9th Court Alipore is hereby quashed.

Thus, CRR 2430 of 2023 is allowed.

Pending connected application, if any, is consequently disposed of.
