Report submitted by the learned advocate appearing for the State be also kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner.

The petitioner is aggrieved by the fact that certain public officials are involved in accepting money on the garb of settling a dispute.

State has submitted a report which reflects otherwise that somebody else impersonating himself as an advocate took the money and the police authorities have been tried to be roped in and the same is because of the deception suffered by the petitioner at the behest of some other person but not by any public servant.

Be that as it may, petitioner insists that he has been cheated by the public servant concerned. Having regard to the same and the provisions of Section 175(4) of BNSS permits the aggrieved

person to ventilate his grievance before the Learned Magistrate, I grant Liberty to the petitioner to approach the jurisdictional magistrate.

The jurisdictional Magistrate would assess and ascertain the genuinity of the allegations and thereafter pass necessary directions as he deems fit and proper.

With the aforesaid observations, the writ petition being WPA 15463 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
