From a report filed by the Officer in Charge, Karaya police station signed on July 17, 2025 in Court, it surfaces that in response to the complaint filed by the petitioner, a case being Karaya PS Case No.41 dated February 17, 2025 under Sections 120B/408/467/468/471 IPC has been registered against the private respondents being respondent nos.4, 5 and 6. The report also mentions that the investigation is in progress. 2.

The allegation of the petitioner is fraudulent transfer of shares.

Learned senior advocate for the petitioner alleges that Sections with lighter punishment have been invoked for the primary reason to provide assistance to the private respondents. Prayer has

been made to transfer the investigation to a specialized agency.

Learned senior counsel representing the private respondents denies the allegations of the petitioner.

Upon hearing both the parties and on perusal of the report of the Officer in Charge of Karaya police station, it appears that the investigation is still in progress.

I am of the opinion that the investigation ought to proceed strictly in the right direction in accordance with the provisions of law invoking proper sections.

Accordingly, I dispose of the writ petition by directing the Deputy Commissioner of Police, South East Division, Kolkata, the second respondent herein, to oversee the process of investigation and ensure that the same concludes at the earliest without any unnecessary delay. 8.

It is made absolutely clear that this Court has not entered into the merits of the allegations and counter-allegations of the parties; and it is the absolute prerogative of the investigating officer to proceed with the investigation in accordance with law.

All parties are to act on the server copy of this order duly downloaded from the official website of this court.

Certified copy of this order, if applied for, shall be made available to the parties.
