A direction to secure expeditious disposal of an application for injunction under Order 39 Rules 1 and 2 of the CPC, is the ultimate relief sought for in this case.

No other point is raised requiring address by this Court.

As per submission disclosed by the petitioners, the application for injunction with a prayer for ad interim order of injunction was filed on 1st June, 2019, but the same could not be taken up due to the caveat being lodged.

In the meantime, the opposite parties have already entered their appearance and written objection against the injunction application has already been filed.

In view of the nature of the order proposed to be made in the case, referred above, no prior notice is considered to be necessary.

Service upon the opposite parties is thus dispensed with.

Accordingly, learned Civil Judge (Senior Division), Serampore in Title Suit No. 192 of 2019 is requested to ensure expeditious disposal of pending injunction application three weeks after Puja vacation of the Court below, providing sufficient opportunity of hearing to either of the parties to this case, but without granting unnecessary adjournment, unless it is extremely unavoidable.

Petitioners are directed to make communication of this order to the learned court below as well as to the learned advocate appearing in the court below for the opposite parties and the opposite parties. With this observation and direction, the revisional application stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
