On prayer of the petitioner, liberty is granted to expunge the names of the 8th and 9th respondents from the cause title of the application.

The petitioner alleges that the respondents have constructed a road by encroaching upon the land of the petitioner without acquiring the same and without obtaining consent from the petitioner.

On prayer of the petitioner, liberty is granted to submit a comprehensive representation ventilating his grievance before the District Magistrate, Paschim Medinipur, being the 3rd respondent herein within a week from date. The 3rd respondent is directed to consider and dispose of the same within four weeks from the date of receipt thereof upon granting reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. Pursuant to such decision, necessary consequential steps be taken at the earliest.

The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
