Petitioner is aggrieved by the fact that in spite of final determination of rights by the Civil Court in T.S. 302/13 wherein the Civil Court has directed that the right, title, interest and possession over the scheduled property is in favour of the petitioner. It has been complained that the private respondents are disturbing the peaceful possession of the petitioner and is obstructing the free egress and ingress.

To that effect information was furnished to the police authorities, the police authorities on enquiry did not find any disturbance being created or any issue relating to theft.

Having considered that there is a decree of the Civil Court and a proceeding under Section 126 of the BNSS having been drawn up, I direct the police authorities to ensure that the decree of the Civil Court be

respected, obeyed and implemented. Police authorities would oversee that no untoward incident results because of the strained relationship existing between the petitioner and the private respondents.

With the aforesaid observations WPA 15637 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
