The only contention expressed by the petitioner is against the delay caused in the submission of learned Investigation Commissioner's report, which was allowed on 19th September, 2016, upon making appointment of learned Investigation Commissioner under Order 26 Rule 9 C.P.C.

No other point is raised requiring address by this Court.

In view of the nature of order proposed to be made in this case, no prior notice is considered to be necessary.

Service upon the opposite party stands dispensed with.

Accordingly, learned Civil Judge (Junior Division), 4th Court, Howrah, in Title Suit No.201 of 2009, is requested to ensure expeditious collection of learned Investigation Commissioner's report upon completion

of the commission work, so that logical conclusion of the suit may be reached in a faster mode.

With this observation/direction, the revisional application stands disposed of.

Petitioner is directed to make communication of this order to the learned court below as well as to the opposite party and his learned advocate in the court below.
