(Via Video Conference) Mr. Gopal Mondal ...for the petitioner Mr. Wasim Ahmed, Ms. Tuli Sinha ...for the State The writ petitioner complains of torture and obstruction and restraint by the respondent no.6 in entering into at 18A, Ram Kanta Bose Street, P.O.- Bagbazar, P.S.- Shyampukur, Kolkata.

The Officer-in-Charge, Shyampukur Police Station has submitted instructions to the learned Government Pleader on November 15, 2021.

It appears therefrom that the petitioner has been inducted in a flat by one Asit Kumar Saha. There are disputes and differences between the said petitioner and the said Asit Kumar Saha who is his cousin brother.

This Court is of the view that the writ petition has been filed for collateral purposes. The dispute between the petitioner and the private respondent is primarily civil in nature.

Hence, the instant writ petition shall stand dismissed with cost assessed at Rs. 5,100/- payable by the petitioner to the Shyampukur Police Station.

Urgent photostat certified copy of this judgment, if applied for, be given to the parties upon compliance of all formalities.
