Affidavit-of-service filed by the petitioner be kept with the record.

Petitioner is aggrieved by the fact that his peaceful enjoyment in respect of the property is obstructed at the behest of the private respondents. To that effect, information was furnished with the police authorities. However, no steps have been taken.

On the other hand, learned advocate for the State has submitted a report wherefrom it reflects that the police authorities directed the petitioner to produce the relevant documents relating to the property where the temporary structure is attempted to be constructed.

Having regard that the right, title, interest and possession of a property is to be decided by the civil court and the police authorities have hardly any role to assess regarding the same, I direct the police authorities would only oversee that there is no breach of the peace and/or tranquility and/or any other untoward incidents resulting from the inimical relationship existing between the petitioner and the private respondents.

With the aforesaid observations, WPA 15682 of 2025 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
