1. Affidavit of service filed on behalf of the petitioner is taken on record.

2. Petitioner made transfer application on the ground of distance in between the present school of the petitioner and his place of residence. Such application was made on Utsashree Portal on 23rd July, 2022 and the school authority where petitioner is working forwarded the transfer application to the concerned District Inspector of Schools (SE) for taking further steps. The District Inspector of Schools (SE) in his turn processed the transfer application and forwarded the same through portal on 29th August, 2022 to the West Bengal Central School Service Commission for taking decision. Grievance of the petitioner is after receipt of transfer application far back on 29th August,

2022 till date Commission has not decided the said transfer application.

3. Respondents are represented by learned advocates who have submitted due to suspension of portal with effect from 29th September, 2022 contemporaneous decision could not be taken on transfer application.

4. It is submitted on behalf of Commission if concerned authority is directed transfer application shall be decided in accordance with law.

5. Having considered the submissions made on behalf of the parties writ petition stands disposed of directing the Chairman, West Bengal Central School Service Commission to decide transfer application of the petitioner by 6 (six) weeks from the date of communication of this order and the decision to be taken by the respondent no. 4 shall be communicated to the petitioner by fortnight thereafter.

6. It is made clear that suspension of portal shall not be a ground to reject transfer application.

7. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
