1. None appears on behalf of the appellant and the respondent nos. 1 to 3, 5 and 7 to 9.

2. In pursuance of the direction passed by this Court dated 3.4.2025, a report is submitted by the S.I. of Police, Uttarpara P.S., CPC stating that during pendency of this appeal, the appellant/complainant, namely, Biswanath Ghosh has been expired on 19.01.2014. The said report also indicates that the respondent no. 6, namely, Dilip Banerjee and respondent no. 4 Gour Gopal Chakraborty also died during the pendency of this appeal.

3. The instant appeal is preferred at the behest of the appellant/complainant challenging the order of acquittal dated 5.8.2000 passed by the learned Sub-Divisional Judicial Magistrate, Serampore.

4. I have perused the impugned judgment and order passed by the learned Trial Court and have also gone through all relevant documents as available on record. After going through the

same, I find there is nothing to interfere with the impugned judgment.

5. Accordingly, this instant appeal be and the same is hereby dismissed on merit.

6. Let a copy of this order along with TCR be sent down to the learned Trial Court immediately.

7. Urgent photostat certified copy of the order, if applied for, be given to the parties upon complying with all legal formalities. (Prasenjit Biswas, J.)
