Report submitted by the learned advocate appearing for the State be also kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner.

The petitioner is aggrieved by the parking of certain auto-rickshaws which are the cause of trouble for carrying on his business as the petitioner has a furniture shop which is being blocked by parking of such auto-rickshaws. To that effect, representation was advanced on or about July, 2024 before different authorities. However, no steps have been taken.

State has submitted a report which reflects that on an earlier occasion on the complaint of the petitioner, Belghoria Police Station Case No. 135 of 2024 was registered for investigation under the relevant provisions of law and on conclusion of investigation, charge-sheet has been submitted.

As presently the prayer of the petitioner is restricted to parking of auto-rickshaws, I direct that the respondent no.4 being the Deputy Commissioner of Police (Traffic), Barrackpore Police Commissionerate will consider the representation of the petitioner dated 06.07.2024 within a period of 45 days from the date of communication of this order. Petitioner be afforded opportunity of hearing. Objections, if any, be considered by the concerned office/officer and the outcome be also communicated to the petitioner within a week from the said 45 days.

With the aforesaid observations, the writ petition being WPA 15689 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
