Petitioner is not inclined to press CRAN 1 of 2023. Accordingly, the same is dismissed as not pressed. Learned advocate for the petitioner prays for expeditious disposal of case No.N-122 of 2022 on the issue that the lady who has been implicated in this case is of tender age and she is in custody since 23rd August, 2022. It has been informed that the charge has been framed on 16th May, 2023.
Having regard to the number of witnesses cited in the charge-sheet which is about 13, I direct that the learned trial court having regard to the tender age of the girl/lady who is in custody should fix at least a schedule consisting of 3 dates and such schedule be fixed once in every 2 months so that all efforts be taken to conclude the trial within a reasonable period of time.
The superintendent of police of the concerned district would monitor the presence of the witnesses so fixed. Learned trial court would send the list of witnesses who belonged to the police department.
The superintendent of police would immediately respond to the special court regarding the availability of the witnesses and ensure their presence on the date so fixed. No unnecessary adjournment should be granted to either of the parties.
Learned Public Prosecutor conducting the case would make available all the necessary documents, statements, materials and exhibits on the date on which the witness would appear before the court. All stakeholders must cooperate with the court to complete the trial within a reasonable period of time.
With the aforesaid observations, CRR 2434 of 2023 is disposed of.
Pending application, if any, is consequently disposed of.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified copy of this order, if applied for, be made available to the parties upon compliance of all requisite formalities.
