Petitioners are aggrieved by the fact that in spite of directions passed by the civil court in T.S.299 of 2024 wherein police authorities were directed for compliance in respect of injunction order, the same is violated by the private respondents and they are continuing construction at the disputed property. State has submitted a report prepared by the Officer-in-Charge, Kharagpur (L) P.S. Report reflects that already a construction is existing and no new construction is being proceeded with.

Police authorities are aware regarding the civil court's order having been passed and are taking steps. As such, if there is any breach of the order passed by the civil court, petitioners would prefer an appropriate

application under the relevant provisions of the Civil Procedure Code before the learned Civil Judge for passing specific directions. Police authorities would also continue their surveillance and ensure that no untoward incident results because of the strained relationship existing between the petitioners and the private respondents.

With the aforesaid observations, WPA 15691 of 2025 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioners. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
