Affidavit-of-service filed by the petitioner be kept with the record.

Petitioner is aggrieved by the fact that certain obstructions are created in front of the shop of the petitioner and to that effect, a representation was made to the police authorities.

On the contrary, State has submitted a report wherein it reflects that the present owner of the property is in possession of the property for the last nine years and on thorough enquiry it was found that the disputed property in front of Vivekananda Seva Sadan, Northern side of Nalua Road, Krishnachandrapur, under Mathurapur P.S. is a property belonging to the Public Works Department.

Having considered the prayer advanced by the petitioner so far as demarcation and/or the manner in which it has been used, police authorities are not in a position to take any steps. However, since the dispute has cropped up, if any crisis of law and order arises, police authorities would ensure that there is no breach of the peace and/or tranquility and/or any untoward incident resulting from the inimical relationship existing between the parties. With the aforesaid observations, WPA 15692 of 2025 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
