Versus

Gour Gayen Ct. 8 (Through Video Conference) The appellant is not represented nor any accommodation is prayed for on behalf of the appellant.

The appeal is defective. In spite of repeated opportunities being given to the appellant to remove the defects, no step has been taken by the appellant to remove the said defects. However, it appears from the report of the Additional Stamp Reporter that the appeal is not maintainable in view of Section 21(1)a of the Bengal, Agra and Assam, Civil Court (West Bengal Amendment) Act, 2000. As the appeal has been preferred against the order of the learned Civil Judge (Senior Division), 2nd Additional Court, Burdwan in a suit valued at Rs.49,025/-, we concur with the report of the Additional Stamp Reporter.

Accordingly, the appeal is dismissed as not maintainable. Original certified copy may be returned to the appellant upon filing a photostat copy of the same in order to enable the appellant to take appropriate steps in accordance with law. (Kesang Doma Bhutia, J.) (Soumen Sen, J.)
