Learned advocate also submits that there has been no recovery from the possession of the present petitioner and he has been implicated on the basis of the statement of a co-accused. Learned advocate for the State, on the other hand, opposes the prayer for bail.

I have considered the materials in the case diary and the locus of the present petitioner.

Having regard to the period of detention and the complicity of the present petitioner in respect of the materials appearing in the case diary, I am inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Hosen Mondal @ Hasen Mondal shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Special Judge (under NDPS Act)-cum-ADJ, 3rd Court, Balurghat, Dakshin Dinajpur.

If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned trial court and shall not leave the jurisdiction of Dakshin Dinajpur District without prior intimation to the learned trial court.

In case, there is any violation of the aforesaid conditions, the trial court would be at liberty to cancel the bail without further reference to this court. Accordingly, CRM (NDPS) 878 of 2025 is allowed. Pending application(s), if any, is also disposed of. Report so submitted be kept with the record.
