The limited grievance of the petitioner is that the petitioner, despite being a bulk consumer of electricity, is suffering since regularly the WBSEDCL is disconnecting the electricity supply of the petitioner and subsequent restoring the same upon payments being made by the petitioner.

On each such occasion, the disconnections are being effected without prior notice, it is alleged. 3.

Learned counsel for the petitioner insists that the WBSEDCL be restrained from disconnecting the petitioner's electricity supply in future without giving prior notice.

Learned counsel for the WBSEDCL submits that the petitioner is a habitual defaulter, for which repeated disconnections have been effected.

It is denied by the WBSEDCL that on any of the occasions the disconnection was effected without prior notice.

Be that as it may, since the law stipulates that prior notice to be given before a disconnection, WPA 15736 of 2023 is disposed of with the rider that the WBSEDCL, on each occasion of disconnection, shall give a prior notice to the petitioner.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
