Leave is granted to the learned advocate on record of the petitioner to implead the Director of Pension, Provident Fund and Group Insurance, Purta Bhaban, Kolkata as party respondent in the present writ application.
The petitioner is a retired teacher of a Primary School. He attained his normal age of superannuation on 30th November, 2020. His grievance is that after his superannuation he is not getting his retiral dues as his service details has been wrongly entered in the e-portal maintained by the respondent authorities.
From the instructions received by the State respondents it appears that the date of appointment of the writ petitioner has been wrongly entered in the e-pension portal. The pension file was retained by the Deputy Director of Accounts, School Education Department, Malda for a long time for rectification of the discrepancy in IOSMS portal.
The Assistant Director, DPPG, Purta Bhaban, Kolkata was informed by the District Inspector of Schools (Primary Education), Malda requesting for correction of joining date of the petitioner. But no such correction has been made till date. As long as the aforesaid correction is not made at the end of the DPPG West Bengal in the epension portal, the pension file of the writ petitioner cannot be re-submitted for finalization of his pensionary benefit.
It appears from the submissions made on behalf of both the parties that due to some mistake in uploading the basic details of the petitioner in the e-pension portal, the petitioner is unable to receive his retiral dues. The mistake is to be rectified immediately. The petitioner ought not to suffer for a mistake which has crept at the time of uploading the service details of the petitioner in the e-Pension Portal. All the details along with necessary records of the petitioner are available in the office of the respondent authorities.
In view of the above, the instant writ petition is disposed of by directing the Director of Pension, Provident Fund and Group Insurance and the District Inspector of Schools (Primary Education), Malda to take immediate necessary steps for correction of the service details of the petitioner in the e-pension portal so that the petitioner may receive his terminal benefits at the earliest. The rectification shall positively be done within a period of two weeks from the date of communication of a
copy of this order. The authorities will thereafter proceed to finalize the pension file of the petitioner and ensure that the dues of the petitioner are released within a period of six months from the date of uploading the correct details of the petitioner in the e-pension portal.
The writ petition stands disposed of.
The instructions given by the District Inspector of Schools (Primary Education), Malda be retained with the records.
Urgent certified photo copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
