The appeal has been filed against judgment and order dated 12th July, 2001 passed by the learned Metropolitan Magistrate, 6th Court, Calcutta in Complaint Case No. C-759 of 1997 acquitting the appellant.

Under the facts and circumstances, instant appeal is dismissed for non-prosecution.

Copy of the order along with lower court record be sent to the Department as well as learned trial Court for immediate compliance.
